Welcome to Kitly!

These Terms of Service ("Terms") govern your use of the Kitly website at https://trykitly.app ("Website") and the services provided by Kitly ("we," "us," or "our"). By creating an account or using our Website and services, you agree to these Terms.

1. Description of Kitly

Kitly is a platform for creators. It lets you connect your social accounts to build a verified media kit, estimate what to charge for sponsored content, discover brand campaigns, and generate AI-assisted pitches to help you land brand deals.

2. Accounts and Connected Platforms

To use Kitly you create an account (via Google sign-in or an email magic link). You may connect third-party platforms such as Instagram, YouTube, and TikTok through their official APIs. By connecting a platform, you authorize us to access the profile and metrics data those APIs make available, solely to power your media kit and related features. You can disconnect a platform at any time, and you are responsible for complying with each platform's own terms of service.

3. Subscriptions and Billing

Kitly offers a free plan and a paid "Pro" plan, billed monthly or yearly through our payment processor, Stripe. Paid subscriptions renew automatically until cancelled. You can cancel at any time, and your Pro access will continue until the end of your current billing period. Except where required by law, fees already paid are non-refundable.

4. Acceptable Use

You agree not to misuse the service, including by submitting false or misleading information, attempting to access data you are not authorized to access, interfering with the platform's operation, or using Kitly to violate the terms of any connected platform or applicable law.

5. AI-Generated Content and Estimates

Some features, including pitch drafts and rate suggestions, are generated automatically (in part using third-party AI). These are provided to assist you and are illustrative only — they are not guarantees of earnings, deal outcomes, or accuracy. You are responsible for reviewing and editing any content before you send or rely on it.

6. Intellectual Property

You retain ownership of the content you provide (such as your media kit details, bio, and images). You grant us a limited license to host and display that content to operate the service. We retain all rights to the Kitly platform, software, and branding.

7. User Data and Privacy

We collect and process personal data as described in our Privacy Policy at https://trykitly.app/privacy-policy. By using the Website, you consent to that processing.

8. Disclaimers and Limitation of Liability

The service is provided "as is" without warranties of any kind. Metrics are sourced from third-party platform APIs and may be delayed or unavailable. To the maximum extent permitted by law, Kitly is not liable for any indirect or consequential damages arising from your use of the service.

9. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

10. Updates to the Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Website.
